Congress Leave Law to Stop Strike Abuses Firm.
President Carlos Alvarado and the Minister of Labor and Social Security, Geannina Dinarte, signed on Monday the Law to Provide Legal Security to the Right to Strike and its Procedures.
This is file 21.049 approved in second debate by 35 congressmen on January 16, after the legislator Carlos Ricardo Benavides presented it the previous year and was given a quick route for approval.
“Costa Rica spent a lot of time in an environment of uncertainty and chaos in the matter of strikes,” said Congressman Benavides.
“Rather than enshrining a right, enormous impunity was generated for a group that abused the majority, trampling their rights to health and education, among others. This new law establishes a balance, a new balance, so that the strike remains a right, but without allowing a few to abuse the majority, ”the president added.
For her part, Minister Dinarte said that while the strike is a right recognized in the Labor Code designed for all workers in our country, “we reiterate our call from the Ministry of Labor and Social Security to resort to the route of social dialogue as the fundamental tool for the maintenance of our democracy and the social peace that characterize Costa Rica ”.
The bill declares illegal strikes in essential public services whose suspension, discontinuity or paralysis can cause significant damage to the rights to life, health and public safety. It also suspends the payment of the wages of workers who participate in these movements.
